1. Overview

MindfulChirp ("the App", "we", "us") is a meditation interval timer for Android. This Privacy Policy explains how the App handles information about you. The short version: we collect nothing.

2. Information We Do Not Collect

We do not collect, process, transmit, or store any of the following:

• Personal identification information (name, email address, phone number, etc.)
• Device identifiers (IMEI, Advertising ID, Android ID, etc.)
• Location data (approximate or precise)
• Usage statistics or analytics events
• Crash reports or diagnostics sent to us
• Microphone, camera, or sensor data
• Contacts, calendar, or any other on-device data
• Financial or payment information
• User-generated content

There is no account creation, no login, and no user profile of any kind.

3. Data Stored Locally on Your Device

Your interval settings (duration and repeat count) and sound preference are held in the App's memory only while the App is running. These settings are not saved to disk and are reset to defaults each time the App is launched. No personal data is involved.

Android's system backup (allowBackup) is enabled, but because the App stores no meaningful persistent data, effectively nothing is ever backed up to Google's servers via this mechanism.

4. Android Permissions Explained

The App requests only the permissions strictly necessary for its core function:

• FOREGROUND_SERVICE / FOREGROUND_SERVICE_MEDIA_PLAYBACK — allows the timer to keep running while the screen is off or while you use other apps, without being killed by the system.
• WAKE_LOCK — keeps the device CPU active so the timer can count and play a sound at the correct moment, even with the screen off.
• POST_NOTIFICATIONS (Android 13+) — displays an ongoing silent notification so you can see the timer progress and stop it from the notification shade. The timer still runs if you deny this permission.

The App does not request INTERNET, READ_CONTACTS, ACCESS_FINE_LOCATION, RECORD_AUDIO, READ_MEDIA_*, CAMERA, or any other sensitive permissions.

5. Third-Party Services and SDKs

MindfulChirp does not integrate any third-party SDKs for advertising, analytics, crash reporting, social sign-in, or any other purpose. No data leaves your device through the App.

6. Children's Privacy

The App does not knowingly collect any information from children or from any user. Because no data is collected at all, the App is compliant with children's privacy regulations (including COPPA) by design.

7. Changes to This Privacy Policy

If the App ever changes in ways that affect privacy (for example, adding a feature that stores data), this Privacy Policy will be updated with a new "Last updated" date. We encourage you to review this page periodically. Continued use of the App after changes constitutes acceptance of the updated policy.

1. Acceptance of Terms

By downloading, installing, or using MindfulChirp ("the App"), you ("User") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App.

These Terms constitute the entire agreement between you and the developer of MindfulChirp regarding your use of the App. No other representations, warranties, or agreements apply.

2. Description of the App

MindfulChirp is a personal meditation interval timer. It allows users to set timed intervals (1–120 minutes), choose a repeat count or run indefinitely, and plays a brief audio chime at the end of each interval. The App is designed and intended exclusively as a mindfulness and meditation aid.

3. License to Use

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to install and use the App on Android devices you own or control, solely for your personal, non-commercial meditation and relaxation purposes.

You may not:

• Copy, modify, or distribute the App or its source code without explicit written permission;
• Reverse-engineer, decompile, or disassemble the App;
• Use the App for any commercial purpose without prior written consent;
• Use the App in any way that violates applicable law.

4. Disclaimer of Warranties

We do not warrant that:

• The App will function without interruption, error, or delay;
• The timer will fire at exactly the configured time on all devices or under all conditions;
• The App will be free of bugs, defects, or harmful components;
• Any defect will be corrected;
• The App is suitable for any specific purpose beyond personal meditation aid.

5. Timer Reliability — Critical Notice

The timer relies on an Android foreground service and a partial wake lock. While these are designed to keep the timer running in the background, they are not guaranteed to fire at precise times under all conditions, including but not limited to:

• Aggressive battery optimization or power-saving modes on certain Android manufacturers' devices;
• The operating system killing background services under memory pressure;
• Device restart or shutdown;
• The user force-stopping the App or swiping it from the recents list;
• Software bugs or hardware failures;
• Wake lock duration caps (the App caps wake locks at 4 hours);
• OS updates that change background execution policies;
• Low battery states where the OS restricts wake locks.

If you need a reliable alarm for an important deadline, use a dedicated alarm application, a hardware timer, or another method specifically designed for critical time-keeping.

By using the App, you acknowledge and accept the risk that the timer may not chime as expected, and you agree that we bear no responsibility for any consequences arising from missed or delayed alerts.

6. Audio Output and Hearing Safety

The App plays audio chimes at the end of each interval. Please be aware of the following risks:

• Alarm audio stream: The App uses the Android alarm audio stream (USAGE_ALARM), which is designed to bypass silent or vibrate mode. The chime will play audibly even when your device is set to silent.
• Volume: The volume of the chime follows your device's alarm volume setting. If you are wearing headphones or earbuds, or have your device at maximum volume, the sound may be unexpectedly loud.
• Hearing risk: We strongly advise you to set your device volume to a comfortable, safe level before starting the timer, especially if you are using headphones, earbuds, hearing aids, or any audio device placed near or in the ear canal.
• Do not use at high volume for extended sessions. Repeated exposure to loud chimes over many cycles can contribute to noise-induced hearing loss.

We are not liable for any hearing damage, tinnitus, auditory discomfort, or related medical conditions arising from use of the App at any volume level. Users with hearing sensitivities, existing hearing conditions, or who use auditory prosthetics should consult a medical professional before use and exercise particular caution with volume settings.

The App is not a medical device and is not intended to diagnose, treat, cure, or prevent any medical condition, including hearing disorders.

7. Limitation of Liability

This limitation of liability applies to, but is not limited to, damages arising from:

• Missed deadlines, appointments, medication doses, or any time-sensitive event;
• Failure of the timer to fire or to fire at the correct time;
• Hearing damage, tinnitus, or other auditory or medical conditions;
• Data loss (including the loss of in-memory settings when the App is closed);
• Device malfunction, battery drain, or system instability;
• Any claim that the App failed to meet your expectations or requirements;
• Any other loss or damage of any nature whatsoever.

To the extent that any jurisdiction does not allow the exclusion or limitation of liability for certain damages, our liability in such jurisdiction shall be limited to the maximum extent permitted by law.

8. Indemnification

You agree to defend, indemnify, and hold harmless the developer of MindfulChirp and any affiliates, licensors, service providers, or successors from and against any claims, liabilities, damages, judgments, awards, losses, costs, or expenses (including reasonable attorneys' fees) arising out of or relating to your use of the App or your violation of these Terms.

9. Not a Medical Device or Professional Service

MindfulChirp is a general-purpose personal timer application. It is not a medical device, not a therapeutic tool, and not a substitute for professional medical, psychological, or mental health advice, diagnosis, or treatment. Nothing in the App constitutes medical advice.

If you are experiencing a medical or mental health condition, consult a qualified healthcare professional. Do not delay seeking medical attention based on information or features provided by this App.

10. App Availability and Updates

We reserve the right to modify, suspend, or discontinue the App (or any feature thereof) at any time without notice and without liability to you. We do not guarantee continuous availability of the App.

Operating system updates may affect the App's functionality. We are not obligated to release updates or maintain compatibility with future versions of Android.

11. Governing Law

These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising from these Terms or your use of the App shall be resolved in the competent courts of the jurisdiction where the developer is domiciled, unless applicable law requires otherwise.

12. Severability

If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

13. Changes to These Terms

We reserve the right to update these Terms at any time. Changes will be reflected by updating the "Last updated" date at the top of this page. Your continued use of the App after any changes constitutes your acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the App.
